This is a 9% increase from 2016 data.<\/p>\n\n\n\n<p>So, chances are, you\u2019ll need the services of independent workers at some point.<\/p>\n\n\n\n<p>If you follow these steps, paying them doesn\u2019t have to be complicated at all.&nbsp;<\/p>\n\n\n\n<h3 id=\"step-1-properly-classify-the-worker\" class=\"wp-block-heading\">Step #1: Properly classify the worker<\/h3>\n\n\n\n<p>Always make sure the people you work with are<strong> legally classified as <\/strong><strong>either<\/strong><strong> regular employees or 1099 contractors (independent)<\/strong>.<\/p>\n\n\n\n<p>Regular employees are individuals under a contract of employment (expressed or implied, oral or written) that specifies employees\u2019 rights and duties. They are employed for a salary or wages, and classified as <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-w-2\" target=\"_blank\" rel=\"noreferrer noopener\">W-2 employees<\/a> \u2013 <strong>all their taxes, benefits, and insurance are handled by the employer they work for.<\/strong><\/p>\n\n\n\n<p>On the other hand, <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/independent-contractor-defined\" target=\"_blank\" rel=\"noreferrer noopener\">independent contractors<\/a> are self-employed. They <strong>pay their taxes, benefits, and insurance<\/strong>. Once the project is complete, the working relationship is also complete, unless both parties choose to continue with another project.\u201d<\/em><\/p>\n<\/div>\n<\/div>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 id=\"regular-employee-vs-independent-contractor-irs-rules\" class=\"wp-block-heading\">Regular employee vs. independent contractor: IRS rules<\/h4>\n\n\n\n<p>There are several rules that help you determine whether a professional is an employee or an independent contractor:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Behavioral rules<\/strong> \u2014 is the company that hired the worker in control of how the worker does their job? If it is, the worker is a regular employee, if not, the worker is likely an independent contractor.&nbsp;<\/li>\n\n\n\n<li><strong>Financial rules<\/strong> \u2014 is the payer (the person who hired an independent contractor) in control of the economic aspects of the hired worker\u2019s job, such as how they\u2019re paid and whether all their expenses are reimbursed? Payers are in control of the economic aspects for regular employees, while that\u2019s not the case for independent contractors.&nbsp;<\/li>\n\n\n\n<li><strong>Type of relationship<\/strong> \u2014 is the payer-worker relationship based on a written contract and includes employee benefits? Also, contractors with less experience may not have the means to pay all project costs without <a href=\"https:\/\/clockify.me\/learn\/business-management\/time-materials-contract\/\" target=\"_blank\" rel=\"noreferrer noopener\">getting paid for the materials<\/a> upfront (alternatively, contractors may also pay for their own materials, and later request such costs from their client).<\/p>\n\n\n\n<h3 id=\"step-4-make-payments\" class=\"wp-block-heading\">Step #4: Make payments<\/h3>\n\n\n\n<p>Depending on the agreed payment terms, you\u2019ll either have to pay the contractor a lump sum or divide the payment into installments. This includes the amount paid, the date of payment, and any additional expenses that were reimbursed. These records will be necessary for tax purposes and in case of any disputes.\u201d<\/em><\/p>\n<\/div>\n<\/div>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>When an independent contractor doesn\u2019t provide their TIN, you have to deduct <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/backup-withholding\" target=\"_blank\" rel=\"noreferrer noopener\">backup withholding taxes<\/a> from their earnings at the rate of 24%. If the contractor doesn\u2019t pay their taxes on their own, you\u2019ll be responsible for doing that using the backup taxes you withheld from them.&nbsp;<\/p>\n\n\n\n<p>You report the withheld taxes by filling out <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-945\" target=\"_blank\" rel=\"noreferrer noopener\">Form 945<\/a>. So, if you\u2019re not in a hurry, you may want to consider other options.<\/p>\n\n\n\n<h3 id=\"method-5-credit-card\" class=\"wp-block-heading\">Method #5: Credit card<\/h3>\n\n\n\n<p>Credit card payments are appealing because they are highly secure and often easily reversible in case of fraud.<\/p>\n\n\n\n<p>Since you\u2019re paying with a line of credit, you don\u2019t have to worry about fraud affecting your actual money. Moreover, many credit card companies offer zero <a href=\"https:\/\/www.consumerfinance.gov\/rules-policy\/regulations\/1005\/6\/\" target=\"_blank\" rel=\"noreferrer noopener\">fraud liability<\/a>.
