Without clear communication, employees feel micromanaged and constantly surveilled. Paradoxically, this approach puts the actual substance of people\u2019s work second, and micro-metrics first. In some regions, it\u2019s also illegal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Employee monitoring is considered invasive if you:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Run monitoring software in secret<\/strong>, and employees either don\u2019t know they\u2019re being monitored, or can\u2019t see when the monitoring app is active.<\/li>\n\n\n\n<li><strong>Focus only on screen recording<\/strong>, keystroke logging, or mouse activity to judge productivity.<\/li>\n\n\n\n<li><strong>Catch time theft, enforce strict compliance<\/strong>, and police employee behavior, but provide no constructive input.<\/li>\n\n\n\n<li><strong>Give employees no access to their score<\/strong> when criticizing them.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">When employees discover they\u2019re being secretly monitored, it often results in a backlash, such as people pretending to work using tools like mouse jigglers. In fact, a <a href=\"https:\/\/connextglobal.com\/connext-confidence-gap-survey-2025\/\" target=\"_blank\" rel=\"noreferrer noopener\">2025 Connext Global Survey<\/a> found that 66% of workers said they simulated their work at least once. Someone who was proactive starts doing exactly the minimum that shows up on a dashboard and nothing more, because that&#8217;s what&#8217;s being measured and rewarded.\u201d<\/em><\/p>\n<\/div>\n<\/div>\n<\/div><\/div>\n\n\n\n<h2 id=\"is-employee-computer-monitoring-legal\" class=\"wp-block-heading\">Is employee computer monitoring legal?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on your business location, you may not be allowed to track all employee data, even on work computers. In some regions, you must provide formal notice or prove how you access and use people\u2019s data. Here\u2019s what you can and can\u2019t monitor in the EU, US, and other regions.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th><strong>Type of data<\/strong><\/th><th><strong>Region<\/strong><\/th><th><strong>Monitoring law compliance<\/strong><\/th><\/tr><\/thead><tbody><tr><td rowspan=\"3\"><strong>Time and attendance<\/strong><\/td><td>EU<\/td><td><strong>Allowed<\/strong>. Fully permitted on employer-owned systems under the <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/2511\" target=\"_blank\" rel=\"noreferrer noopener\">Electronic Communications Privacy Act<\/a> (ECPA) under the business-purpose exception.<\/td><\/tr><tr><td>Other regions<\/td><td><strong>Mostly allowed.<\/strong> Often recognized as a legitimate business purpose (like the <a href=\"https:\/\/ico.org.uk\/for-organisations\/uk-gdpr-guidance-and-resources\/employment\/monitoring-workers\/\" target=\"_blank\" rel=\"noreferrer noopener\">UK Data Protection Act<\/a>), if you meet the applicable transparency requirements.<\/td><\/tr><tr><td rowspan=\"3\"><strong>Productive vs. idle time<\/strong><\/td><td>EU<\/td><td><strong>Allowed<\/strong> \u2014 but only if the method is proportionate, non-covert, and strictly limited to work hours. Employee monitoring in the EU must pass a <a href=\"https:\/\/ec.europa.eu\/newsroom\/article29\/items\/610169\/en\" target=\"_blank\" rel=\"noreferrer noopener\">strict proportionality test<\/a>.<\/td><\/tr><tr><td>US<\/td><td><strong>Allowed<\/strong> \u2014 but states with electronic monitoring laws (New York, Connecticut, Delaware, and Maine) require a <a href=\"https:\/\/screenjournal.ai\/employee-monitoring-laws-by-us-state\" target=\"_blank\" rel=\"noreferrer noopener\">written notice for employee monitoring<\/a>. California requires notice at collection, under the CCPA.<\/td><\/tr><tr><td>Other regions<\/td><td><strong>Often allowed<\/strong> \u2014 only if transparent. For example, the Philippine law recognizes measuring productive vs. idle time as a <a href=\"https:\/\/privacy.gov.ph\/npc-phe-bulletin-no-14-updated-frequently-asked-questions-faqs\/\" target=\"_blank\" rel=\"noreferrer noopener\">legitimate business interest,<\/a> but mandates strict employer transparency.<\/td><\/tr><tr><td rowspan=\"3\"><strong>Websites and app activity<\/strong><\/td><td>EU<\/td><td><strong>Allowed<\/strong> \u2014 but only if strictly limited to what is necessary for the role, complying with data minimization (<a href=\"https:\/\/gdpr-info.eu\/art-5-gdpr\/\" target=\"_blank\" rel=\"noreferrer noopener\">GDPR Art. 5<\/a>). Covert internet monitoring is strictly illegal unless investigating a specific, documented suspicion of serious crime.<\/td><\/tr><tr><td>US<\/td><td><strong>Allowed<\/strong>. Governed federally by the ECPA. State laws (<a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/CVR\/52-C\" target=\"_blank\" rel=\"noreferrer noopener\">NY<\/a>, <a href=\"https:\/\/law.justia.com\/codes\/connecticut\/title-31\/chapter-557\/section-31-48d\/\" target=\"_blank\" rel=\"noreferrer noopener\">CT<\/a>, <a href=\"https:\/\/codes.findlaw.com\/de\/title-19-labor\/de-code-sect-19-705\/\" target=\"_blank\" rel=\"noreferrer noopener\">DE<\/a>, and <a href=\"https:\/\/legislature.maine.gov\/backend\/App\/services\/getDocument.aspx?documentId=121771\" target=\"_blank\" rel=\"noreferrer noopener\">ME<\/a>) require employers to provide prior written notice about monitoring app and internet activity.<\/td><\/tr><tr><td>Other regions<\/td><td><strong>Generally allowed<\/strong>. It\u2019s permitted under frameworks like the UK\u2019s Data Protection Impact Assessment (DPIA), if you follow <a href=\"https:\/\/ico.org.uk\/for-organisations\/uk-gdpr-guidance-and-resources\/data-protection-principles\/a-guide-to-the-data-protection-principles\/data-minimisation\/\" target=\"_blank\" rel=\"noreferrer noopener\">data minimization<\/a> and <a href=\"https:\/\/ico.org.uk\/for-organisations\/uk-gdpr-guidance-and-resources\/data-protection-principles\/a-guide-to-the-data-protection-principles\/lawfulness-fairness-and-transparency\/\" target=\"_blank\" rel=\"noreferrer noopener\">transparency<\/a> principles.<\/td><\/tr><tr><td rowspan=\"3\"><strong>Utilization score<\/strong><\/td><td>EU<\/td><td><strong>Allowed<\/strong> \u2014 only if the employer completes a DPIA prior to deployment. Employee scoring qualifies as \u201csystematic monitoring\u201d under <a href=\"https:\/\/gdpr-info.eu\/art-35-gdpr\/\" target=\"_blank\" rel=\"noreferrer noopener\">GDPR Art. 35<\/a>.<\/td><\/tr><tr><td>US<\/td><td><strong>Allowed.<\/strong> No federal restrictions exist under the ECPA beyond baseline state-level notification requirements.<\/td><\/tr><tr><td>Other regions<\/td><td><strong>Generally allowed<\/strong>.
