The employees\u2019 negligence doesn\u2019t decrease the amount they will receive, nor does the employers\u2019 culpability increase it.<\/p>\n\n\n\n<p class=\"translation-block\">Nonetheless, an employee can lose the right to workers\u2019 compensation if their injury is a consequence of alcohol or drug intoxication or if the injury happened due to reckless behavior (e.g., not respecting safety measures in the workplace).<\/p>\n\n\n\n<p class=\"translation-block\">Each US state has its own regulations regarding workers\u2019 insurance compensation. These regulations include different requirements and exemptions, which we will cover later in the guide.<\/p>\n\n\n\n<h3 id=\"how-does-workers-compensation-insurance-work-in-the-us\" class=\"wp-block-heading translation-block\">How does workers\u2019 compensation insurance work in the US?<\/h3>\n\n\n\n<p class=\"translation-block\">Employers are legally obligated to ensure a safe workplace for their employees.<\/p>\n\n\n\n<p class=\"translation-block\">Therefore, employees who suffer a work-related injury or illness should immediately report it to their employer. After that, this employee can <strong>fill out a workers\u2019 compensation claim form<\/strong> that contains information such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"translation-block\">Injury details,<\/li>\n\n\n\n<li class=\"translation-block\">When did the injury happen,<\/li>\n\n\n\n<li class=\"translation-block\">Where did the injury happen, and<\/li>\n\n\n\n<li class=\"translation-block\">How did the injury happen.<\/li>\n<\/ul>\n\n\n\n<p class=\"translation-block\">Once an employee has completed the form, the employer can submit the claim to the insurance carrier. In addition to the workers\u2019 compensation claim form, the employer might be required to submit additional forms that vary from state to state.<\/p>\n\n\n\n<p class=\"translation-block\">After that, employers must report the injury to the state\u2019s division workers\u2019 compensation board. All <strong>workplace injuries must be reported<\/strong>, even if the employee is not pursuing workers\u2019 comp. The deadline for submitting all forms is typically 7 days.<\/p>\n\n\n\n<p class=\"translation-block\">Then, when the workers\u2019 compensation claim is made, an insurance carrier will determine whether they will accept it or not. If an accident occurs and the employee is injured, the insurance carrier then pays the employee.&nbsp;<\/p>\n\n\n\n<p class=\"translation-block\">Employers can buy workers\u2019 compensation coverage through:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"translation-block\">Workers\u2019 compensation state funds, or<\/li>\n\n\n\n<li class=\"translation-block\">Private insurance companies.<\/li>\n<\/ul>\n\n\n\n<p class=\"translation-block\">Although employers pay workers\u2019 compensation, this comes with a specific tradeoff. Employers with workers\u2019 compensation insurance are <strong>protected from lawsuits from employees<\/strong> who suffer work-related injuries or illnesses.<\/p>\n\n\n\n<p class=\"translation-block\">This makes workers\u2019 compensation coverage a mutual agreement between employers and employees \u2014 and protects both sides.<\/p>\n\n\n\n<h3 id=\"benefits-of-workers-compensation\" class=\"wp-block-heading translation-block\">Benefits of worker\u2019s compensation<\/h3>\n\n\n\n<p class=\"translation-block\">Workers\u2019 compensation has <a href=\"https:\/\/www.usa.gov\/workers-compensation\" target=\"_blank\" rel=\"noreferrer noopener\">benefits for both workers and employers<\/a>.<\/p>\n\n\n\n<p class=\"translation-block\">Regarding <strong>employees<\/strong>, workers\u2019 compensation covers their medical expenses and lost wages in case of a work-related injury or illness. Moreover, injured workers can get additional benefits, such as rehabilitation therapy or healthcare.<\/p>\n\n\n\n<p class=\"translation-block\">On the other hand, <strong>employers<\/strong> are protected in situations where employees are injured on the job. This protection means that employees can\u2019t file civil lawsuits against employers.<\/p>\n\n\n\n<p class=\"translation-block\">For example, an employee might fall from a ladder during work hours and break their leg, which could require surgery. Nevertheless, certain programs protect these types of employees and other specific employee groups.<\/p>\n\n\n\n<p class=\"translation-block\">The most important employee protection programs include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"translation-block\"><a href=\"https:\/\/www.dol.gov\/agencies\/owcp\/FECA\" target=\"_blank\" rel=\"noreferrer noopener\">Federal Employees&#8217; Compensation Program (FECA)<\/a>,<\/li>\n\n\n\n<li class=\"translation-block\"><a href=\"https:\/\/www.dol.gov\/agencies\/owcp\/dlhwc\" target=\"_blank\" rel=\"noreferrer noopener\">Longshore and Harbor Workers&#8217; Compensation Program<\/a>,<\/li>\n\n\n\n<li class=\"translation-block\"><a href=\"https:\/\/www.dol.gov\/agencies\/owcp\/dcmwc\" target=\"_blank\" rel=\"noreferrer noopener\">Federal Black Lung Program<\/a>, and<\/li>\n\n\n\n<li class=\"translation-block\"><a href=\"https:\/\/www.dol.gov\/agencies\/owcp\/energy\" target=\"_blank\" rel=\"noreferrer noopener\">Energy Employees Occupational Illness Compensation Program<\/a>.<\/li>\n<\/ul>\n\n\n\n<p class=\"translation-block\">These programs are administered by the US Department of Labor\u2019s <a href=\"https:\/\/www.dol.gov\/agencies\/owcp\" target=\"_blank\" rel=\"noreferrer noopener\">Office of Workers\u2019 Compensation Programs (OWCP)<\/a>, which provides wage replacement, medical care, rehabilitation, and other benefits to employees with work-related injuries or illnesses.&nbsp;<\/p>\n\n\n\n<h2 id=\"workers-compensation-coverage-types\" class=\"wp-block-heading translation-block\">Workers\u2019 compensation coverage types<\/h2>\n\n\n\n<p class=\"translation-block\">There are 2 types of workers\u2019 compensation coverage:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"translation-block\">Workers\u2019 compensation <strong>coverage A<\/strong>, and<\/li>\n\n\n\n<li class=\"translation-block\">Workers\u2019 compensation <strong>coverage B<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"translation-block\">Let\u2019s look at them in more detail.<\/p>\n\n\n\n<h3 id=\"workers-compensation-coverage-a\" class=\"wp-block-heading translation-block\">Workers\u2019 compensation Coverage A<\/h3>\n\n\n\n<p class=\"translation-block\">Workers\u2019 compensation Coverage A, also known as Part One of the compensation policy, <strong>includes all state-mandatory employee benefits<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"translation-block\">This coverage provides medical expenses, lost wages, rehabilitation, and other benefits to employees regardless of liability.<\/p>\n\n\n\n<p class=\"translation-block\">For example, a cashier can slip on their job and injure their arm. Coverage A can cover parts of their medical expenses, rehabilitation, and lost wages.&nbsp;<\/p>\n\n\n\n<h3 id=\"workers-compensation-coverage-b\" class=\"wp-block-heading translation-block\">Workers\u2019 compensation Coverage B<\/h3>\n\n\n\n<p class=\"translation-block\">Workers\u2019 compensation Coverage B, or Part Two of the compensation policy,<strong> includes additional benefits that coverage A may not cover<\/strong>. Employees can receive these benefits as part of a successful lawsuit against the employer.<\/p>\n\n\n\n<p class=\"translation-block\">Although employees usually waive their right to file a civil suit against the employer when they use the workers\u2019 compensation insurance, in some cases, employees might have the right to sue their employer.<\/p>\n\n\n\n<p class=\"translation-block\">These are mostly cases where the injury or illness happened due to gross negligence from the employer. That\u2019s why workers\u2019 compensation Coverage B is also known as <a href=\"https:\/\/www.iii.org\/publications\/insuring-your-business-small-business-owners-guide-to-insurance\/specific-coverages\/liability-insurance\" target=\"_blank\" rel=\"noreferrer noopener\">liability insurance<\/a> for employers.<\/p>\n\n\n\n<p class=\"translation-block\">For example, a construction worker notices a broken ladder and tells his employer. The employer doesn\u2019t fix the ladder, and the employee falls from it while working, thus breaking his leg.
